About this policy

AIR Performance is operated by AIR ACL Rehab PLLC ("AIR Performance," "we," "us," "our"), a Florida professional limited liability company based in Tampa, Florida.

This policy explains what information we collect, how we use it, and the choices you have. It covers:

  • airperformancefl.com and any landing pages, forms, or funnels we operate

  • Our email newsletter, text messages, and direct messages

  • Inquiries, applications, consultation bookings, and online coaching services

It does not cover sites we link to, or third-party platforms where you contact us such as Instagram and Facebook. Those platforms have their own privacy policies.

By using our website or submitting information to us, you agree to the practices described here.

Information we collect

We collect three kinds of information: what you give us, what is collected automatically, and what other services pass to us.

What you give us. Name, email, phone, city, and anything you type into a form, application, intake questionnaire, or message.

What you give us about your health. Injury history, surgery date and type, symptoms, goals, sport and activity level, training history, video or photos you send of your movement, and testing results.

What is collected automatically. IP address, browser and device type, pages viewed, time on page, referring site, and cookie or pixel identifiers.

What other services pass to us. Ad platforms and analytics providers, our scheduling and CRM software, and our payment processor, which confirms a payment without giving us your full card number.

We do not store full credit card or bank account numbers. Payments are processed by a third-party processor under its own terms.

Only provide the information a form asks for. Do not send sensitive records, imaging, or medical documents through social media messages or unsecured email.

How we use your information

We use what we collect to run the practice and to answer you:

  • Respond to inquiries, applications, and consultation requests

  • Screen for fit, build and adjust rehab or performance programs, and document care

  • Schedule sessions, send reminders, and process payments

  • Send the newsletter, educational content, and updates you signed up for

  • Improve the website, our content, and our services

  • Measure how our ads and content perform, and reach people with similar interests

  • Meet legal, licensing, and professional recordkeeping obligations

We do not use your health information to target advertising, and we do not share it with ad platforms.

How we share information

We do not sell your personal information, and we do not rent or trade your contact list.

We share information only in these situations:

  • Service providers. Companies that run our website, scheduling, CRM, email and text delivery, payment processing, testing software, video hosting, and analytics. They may use your information only to provide their service to us.

  • With your written authorization. We release your records only to you, your legal representative, or another health care practitioner involved in your care. Anyone else needs your written authorization first, including a strength or sport coach, a gym you train at, a referral partner, and the parent of an athlete who is 18 or older.

  • Legal. When required by law, subpoena, or a government request, or to investigate fraud or a threat to safety.

  • Business transfer. If the practice is sold, merged, or reorganized, records may transfer as part of that transaction, subject to this policy.

The providers we currently use:

  • HighLevel (GoHighLevel) for CRM, forms, scheduling, and email and text delivery

  • Stripe for payment processing

  • Squarespace for our website

  • Google Workspace for email, documents, and file storage

  • Everfit for online coaching delivery, programming, and client messaging

  • VALD (ForceDecks, DynaMo) and Tindeq for objective testing data

  • Google Analytics for website traffic measurement

  • Meta (Facebook and Instagram) for advertising and ad measurement

We require every provider to protect the information we give them and to use it only to provide their service to us. Google Analytics and Meta receive website and advertising data only, never your health information.

Testimonials, photos, and video

We do not use your name, image, video, training footage, story, or testing results in any marketing without a separate written media authorization signed by you, or by a parent or guardian if you are under 18.

  • The authorization names the specific use, and you can withdraw it at any time

  • Agreeing to care or coaching is never agreement to appear in our content

  • Withdrawing consent stops future use, though we cannot always recover content already published or reshared by others

Removing your name does not always make content anonymous. We take that into account before posting anything about an individual case.

Health information

We hold the health information of every client to the HIPAA standard of confidentiality, whether you work with us for physical therapy or for performance coaching. Where HIPAA formally applies to your care, our separate Notice of Privacy Practices describes your rights and controls if anything here conflicts with it.

This means:

  • We do not release your health information outside the practice without your written authorization, except where the law requires it

  • Your record of care is kept in our documentation system, not in our coaching app or our marketing tools

  • Objective testing data is stored under a client identifier rather than your name

  • Health information is kept separate from our marketing lists

  • We do not use health information to target advertising, and we do not share it with ad platforms

  • Anything you post publicly or send us through social media is not confidential and is not protected

Our coaching app is a commercial fitness platform, not a medical records system. We use it for programming, training logs, and day to day messaging. Please send medical records, imaging, and detailed health history through the intake forms we provide rather than through app messages.

Florida law protects patient records and the confidentiality of care regardless of which service you receive.

Cookies, pixels, and analytics

Our website uses cookies and similar tracking technologies to keep the site working, remember your preferences, measure traffic, and see which content and ads bring people to us.

This includes analytics tools and advertising pixels from Meta and Google. These providers may set their own cookies and use the data under their own privacy policies.

You can control tracking in these ways:

  • Block or delete cookies in your browser settings

  • Turn on Do Not Track or Global Privacy Control in your browser

  • Adjust ad preferences directly in your Facebook, Instagram, and Google account settings

  • Opt out of interest-based advertising at optout.aboutads.info and youradchoices.com

Blocking cookies may break parts of the site.

Email and text messages

When you give us your email address, we may send you the newsletter, educational content, offers, and practice updates. Every marketing email has an unsubscribe link. Unsubscribing stops marketing email but not messages about your care, appointments, or payments.

When you give us your phone number and opt in, we may text you about appointments, programs, and offers. Message and data rates may apply. Message frequency varies. Reply STOP to any text to opt out and HELP for help. We do not sell or share your phone number with third parties for their own marketing.

Opting in to text messages is never a condition of receiving care.

Minors

Our website and marketing are directed to adults. We do not knowingly collect information online from anyone under 13.

We do work with athletes under 18. When a minor is a client, a parent or legal guardian provides the information, signs the consents, and controls the account. A parent or guardian may review, correct, or request deletion of their child's information by contacting us.

We do not use a minor's photo, video, testing data, or story in marketing without separate written consent from a parent or guardian, and that consent can be withdrawn at any time.

If you believe a child under 13 has given us information, contact us and we will delete it.

Retention and security

We keep information only as long as we need it.

  • Patient and client records: retained for at least seven years after the last date of service, and longer for clients who were minors at the time of care

  • Marketing contacts: kept until you unsubscribe or ask us to delete you

  • Website and analytics data: kept in aggregated or limited form on our providers' standard schedules

We use reasonable safeguards, including encrypted storage, access controls, and vetted vendors. No website or electronic system is completely secure, and we cannot guarantee absolute security. Email and social media messages are not secure channels.

We also keep a log of disclosures of your records to third parties, including the purpose of each request, as Florida law requires.

Your choices

You can ask us at any time to:

  • Tell you what information we hold about you

  • Correct information that is wrong

  • Delete information we are not required to keep

  • Stop sending marketing email or texts

  • Stop using your photo, video, or testimonial

Email us at mattbailey@airperformancefl.com and we will respond within 30 days. We may need to verify your identity first, and we cannot delete records we are legally required to retain.

Residents of California, Colorado, Virginia, and other states with consumer privacy laws may have additional rights. We honor those requests regardless of whether the law applies to a practice our size.

Our services are intended for people in the United States.

Other sites, changes, and contact

Our site links to other websites and platforms we do not control. Their privacy practices are their own.

We may update this policy. The current version is always posted at airperformancefl.com with the effective date at the top. Material changes will be noted on the page, and continued use of the site means you accept the updated policy.
